Terms and Conditions for Christmas Portrait Commissions

1. Commission Scope

   • The artwork provided will be a digital portrait created specifically for the client based on their request, sized at A4 (8.27 x 11.69 inches), and delivered as a digital download.

   • The artwork is for personal use only. Clients may print, display, or share the artwork for personal purposes, but it may not be used for commercial purposes unless explicitly agreed upon in writing.

2. Pricing and Payment

   • The commission price ranges between $100-$250 for the A4-sized digital portrait.

   • Payment is accepted through Wise Transfer only, and full payment must be received before the final digital file is delivered.

   • The artist reserves the right to adjust prices for additional requests (e.g., complex designs, additional subjects) which will be discussed and agreed upon before starting the commission.

3. Delivery and Turnaround Time

   • The final artwork will be delivered as a digital file via email within the agreed timeframe after full payment has been received.

   • Delivery times will vary depending on the artist’s workload, but clients will be notified of estimated completion dates at the time of booking.

   • No physical items (prints, canvases, etc.) will be shipped. The client is responsible for printing the artwork if they desire a physical copy.

4. Revisions

   • One round of minor revisions is included in the commission price (adjusting colors, small details, etc.). Additional revisions may incur extra charges.

   • Major changes (e.g., altering the composition or replacing elements) must be requested early in the process and may result in additional costs.

5. Copyright and Usage Rights

   • The artist retains full copyright and ownership of the commissioned artwork.

   • The client receives a non-exclusive license to use the commissioned artwork for personal purposes, such as sharing on social media (with credit to the artist), or printing for private display.

   • The client may not reproduce, sell, or distribute the artwork in any form without prior written consent from the artist.

   • The artist reserves the right to use the artwork for portfolio purposes, promotion on social media, and other forms of self-promotion unless otherwise agreed upon with the client in writing.

6. Refunds and Cancellations

   • Once payment is made and work has begun, no refunds will be issued unless the artist is unable to complete the artwork due to unforeseen circumstances.

   • If a client cancels before work has started, they will receive a full refund.

7. Client Responsibilities

   • The client must provide clear reference photos and detailed instructions to ensure the artwork aligns with their expectations.

   • The client agrees not to alter, edit, or modify the artwork in any way once delivered. This includes but is not limited to color changes, cropping, or adding elements.

8. Dispute Resolution

   • Any disputes or disagreements about the artwork will be handled privately between the artist and the client to find an amicable solution.

9. Agreement

   • By commissioning a portrait, the client agrees to these terms and conditions.
